These terms govern your use of Hatpass. Read them.
Acceptance of terms
By using Hatpass, you accept these terms. If you don't, don't use the app. We may revise these terms; continued use means acceptance of revisions.
Eligibility
You must be at least 13 years old. If you're under 18, your account is operated under your parent or guardian's authority. To create or cash out a hat, you must be at least 18 and capable of entering a binding agreement under Nigerian law.
Account responsibility
You're responsible for everything that happens under your account. Keep your phone secure. If you lose access, contact support@stalwartcrest.com immediately.
The product mechanic
A "hat" on Hatpass is a named collection of funds gathered from many contributors toward a stated target by a stated deadline, held in a virtual bank account managed by our payments partner on your behalf as the organizer. A "contribution" is a bank transfer made by any third party to that virtual account. A "cash-out" is a transfer of the hat's balance to a destination bank account that you specify, typically your own or a vendor's. Hats are records of group financial activity. They are not loans, not investments, not securities, not regulated savings products, and confer no interest, yield, or return.
Critical disclaimer
Hatpass facilitates informal group collections between trusting parties. Hatpass, Stalwart Crest, Inc., and its affiliates make no representation that any record produced by this app is suitable as evidence in any court of law, regulatory proceeding, or formal arbitration. Hatpass is not a bank, is not a financial advisor, and provides no investment, tax, legal, or accounting advice. The organizer of a hat is solely responsible for representing the purpose of the hat truthfully to contributors and for distributing the funds in accordance with that stated purpose.
Acceptable use
You will not use Hatpass to collect money under false pretenses, to launder funds, to evade taxes, to defraud contributors, to collect for illegal purposes, or in any way that violates Nigerian law or the laws of any jurisdiction in which a contributor or organizer is located. Any hat misrepresenting its purpose may be terminated and funds frozen pending investigation.
Termination
We may suspend or terminate your account if you violate these terms, if we're required to by law or our payments partner, or if your account shows patterns consistent with fraud. You may delete your account anytime per the Privacy Policy.
Limitation of liability
Hatpass and Stalwart Crest, Inc. are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the app, any contribution made or received, any failure of a hat to reach its target, any dispute between organizer and contributors, or any service interruption. Our total liability to you in any matter is capped at the amount of fees you have paid to us in the prior twelve months, which for most people is zero or near zero.
Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Disputes shall be resolved in state or federal courts located in Delaware.
